Gender bias is a real thing that impacts business, politics, and social norms; however, does gender bias impact child custody scenarios? Looking back on family law history, we could without a doubt say that gender bias has historically impacted custody situations but is that still the case in this day in age? In this blog post, we will explore this question and find out if a parent’s gender can impact his or her child custody situation.
General Facts
Five mothers receive custodial rights of their children for every one father. However, is this only true because fathers don’t want to care for their children? Are fathers actively choosing to give custodial rights to mothers? Let’s look at a different statistic.
In just over 51% of custody decisions, both parents agreed that the mother should become the custodial parent. Therefore, in 49% of all custody decisions, both parents wanted custodial rights, or both parents agreed that the father should become the custodial parent.
Therefore, assuming courts split custodial decisions equally between both genders, at least 24.5% of custodial parents should be fathers. However, that isn’t the case, as fathers end up getting custody only 16.5% of the time.
Our Representation Could Make the Difference
At our firm, we compassionately represent both genders in all custody cases. We believe all parents have a right to fight for custody regardless of their sex or age. Fathers clearly have to fight against a bias to win custody; but with the right attorney on their side, they could be one step closer to fighting for their paternal rights.
At The Law Offices of Andrea Schneider, we recognize that fathers have to fight an uphill battle to win custody. If you’re ready for child custody representation that cares for you and your case, take advantage of our free consultation today!
