My name is Attorney Andrea Schneider, and I have been an attorney since 1992. As a mom of 2, I love helping clients with their child custody cases. While representing people in court I pay attention to those representing themselves. Many could have gotten a much better result with some coaching and instruction. I have seen and heard people say the oddest things and things that may really hurt their case. Like the woman who insisted on mentioning her ex’s erectile dysfunction during her child custody case, even when the Judge told her not to mention it again. Amusing but not helpful and she really annoyed the Judge.

The Law Office of Andrea Schneider is conducting CHILD CUSTODY, CHILD VISITATION and CHILD SUPPORT workshops for people who want to represent themselves in their child custody/child visitation/child support case. Many, if not most, cases throughout the country—including California—have one or more parties appearing in court without a lawyer. After attending one of Attorney Andrea Schneider's workshops, you will more confidently and successfully self-represent yourself.

If you chose to represent yourself, you should be properly instructed on how to best do this, by an attorney who handles these cases. Otherwise, you risk hurting your case by not preparing for FCS/mediation, failing to follow certain rules and procedures in court, not giving the Judge what they want in documents and/or in argument, saying the wrong thing……

Representing yourself can be very scary and you can really mess up something very important for your family. This workshop will give you foundational knowledge, confidence and important pointers that will help you negotiate with the other parent, draw up an agreement that can become a court order, prepare for and appear in Family Court Services/Mediation, use the FCS mediators report very effectively and to your benefit, file appropriate documents, appear before a family law judge, know and ask for what you want. All while representing yourself.

The 3 week workshop is divided into three evening sessions covering a wealth of information. Sessions are hosted weekly on Wednesday evenings from 6 PM to 8 PM in Mission Valley. By the end of the full course, you will be more confident and capable to self-represent during your child custody/visitation/child support case.

Each week, we will cover very important issues relevant to your child custody/visitation/support case:

• Session 1: Filings and Paperwork-What if you did your paperwork so well that you barely have to open your mouth when you get to court? Wouldn’t that be great?

• Session 2: Preparing for Family Court Services (FCS)-why this is so important

• Session 3: How to use the FCS/mediation report to your advantage and Preparing for Court-do’s and don’ts.

You will also get a fifteen-minute phone consultation with me, Attorney Schneider, about your specific case.

*Attendees will receive sample copies of forms, a declaration, and a child custody/visitation agreement (this is worth thousands). You can use these samples to modify for your situation.

Session 1: Filings and Paperwork

What if you do your paperwork so well that you barely have to open your mouth when you get to court? I can teach you how.

During the first week’s session, you will learn about court filings, procedures, and strategies, including detailed discussions and tips on the following issues:

• What do you want to modify and why?

Evaluating Previous Court Orders and Agreements: Understanding your original orders under a Marital Settlement Agreement (MSA) or after a Request for Order (RFO) as well as final child custody orders—also known as “Montenegro Orders.” Are they really final?

• Legal and Physical Custody: Learn the difference between legal and physical custody, the implications of each type of custody and what you want and why.

• Child support: Learn about the factors related to child support determinations, if there are participants with support issues.

• Negotiations/Agreements: Learn about child custody/visitation stipulations/agreements. How to negotiate them with the other parent and how you can turn this agreement into a court order. A sample agreement will be given to you for you to turn into a document that is right for your family. (This agreement is worth thousands.)

• Filing Paperwork: Understand the forms and filing requirements for Ex Parte requests/emergency hearings, (including the purpose of such procedures) and regular court hearings in which you are making requests called Requests for Orders/RFO. How to initiate or respond to RFO’s including the importance of great declarations and documents. How to tell the Judge what you want and why?

• Local Rules: Learn rules regarding the time requirements for filing and serving RFOs and Ex Parte matters.As well as page limits.

• Exhibits: Learn the rules for lodging exhibits and supporting documents when filing your paperwork with the court.

• Serving Your Filings: Learn about the service requirements for your filings/documents. If you don’t have good service the Judge will not hear your case.

Session 2: Preparing for Family Court Services

During the second week’s session, attendees will learn how to prepare for your Family Court Services (FCS)/Mediation appointment including issues such as:

• The Importance of Preparation: Learn why preparing for the FCS/Court ordered mediation is SOOOO important-hint-many Judges will totally rely on it.

• The Dos and Don’ts of Family Court Services: Learn what conduct, strategies, and procedures are acceptable and unacceptable at your FCS appointment, and how to come in with a plan. Extremely important.

• Focusing on a Custody and Visitation Plan That is Right for You and Your Kids: FCS appointments can be an opportunity for you and the other party to focus on a plan the serves the best interests of your child. Of course, after this workshop you will already have your “plan” established.

Session 3: Preparing for Court

During the third week’s session, we will cover the all important FCS report, courtroom strategy, rules, and procedures, including tips about:

•FCS Recommendations: Learn how to plan ahead and effectively read, use and fine tune the FCS/mediation recommendation/report to tell the Judge exactly what you want. This is extremely important and worth the cost of the workshop.

• Preparing arguments: Legal argument is different from casual arguments with friends, or heated debates online. Attendees will learn the proper way to argue and things to avoid in your argument. What to say and do. And if you do what you learned in sessions 1 and 2 of this workshop well, you may not have to say much in court and still get what you want!

•Know the Judge and Opposing Counsel: Attendees will learn the importance of familiarizing yourself with the judge for your case and the attorney representing the opposing party.

•Support DissoMaster: Learn how to read a DissoMaster report for child and spousal support payments, and how to use the DissoMaster program. (Only if there are attendees with support issues)

•In-Court Procedures: Attendees will get a rundown of courtroom procedure, including courtroom dress and attire, checking in with the Bailiff, who is Petitioner or Respondent vs. moving party, why not to interrupt the other party, which party goes first.

The goal with our workshop is to help you effectively and successfully represent yourself. After this workshop you will be more confident, have a plan and will do a much better job in representing yourself and the needs of your children.
